The agreement between you and Themefy covering the browser extension and its subscription plans.

Introduction
These Terms of Service (the "Terms") are an agreement between you and Themefy ("we", "us", "our"). They cover the Themefy Chrome extension and everything we provide through it (together, the "Service"). By installing the extension, creating an account or using the Service, you accept these Terms. If you do not accept them, please do not use the Service.
Themefy turns your new tab into a focus space: curated themes and wallpapers, a weather widget, a Pomodoro focus timer with a site blocker, a to-do list, custom bookmarks and quick links, and a lofi audio player. Some features are free; others need a premium or lifetime plan.
Themefy licenses the themes, imagery and other content it ships with, it does not grant you rights beyond using them inside the extension. Section 5 covers what you can and cannot do with that content.
1. Using Themefy and Your Account
You must be at least 16 years old, or at least 13 with the consent of a parent or guardian where local law allows.
An account is created by signing in with Google. You are responsible for everything that happens under your account and for keeping it secure. One account is for one person.
The extension is distributed through the Chrome Web Store and is also subject to that store's terms. It may update automatically so it keeps working, and we may stop supporting older versions.
Tell us at support@themefy.top as soon as you suspect unauthorised use of your account.
2. Plans, Billing and Refunds
Themefy offers a free plan and paid premium and lifetime plans. The features, prices and limits of each are described in the extension and on our pricing page, which forms part of these Terms.
Payments are taken by Dodo Payments, subject to their own terms. Premium subscriptions renew automatically at the then-current price until you cancel; a lifetime plan is a one-time charge and does not renew.
You can cancel a subscription at any time from your account settings or the customer portal. Cancellation takes effect at the end of the current billing period. You keep paid access until then, and we do not pro-rate a partial period.
We will refund a first purchase in full if you ask within 14 days of paying. Refunds after that, and refunds of a renewal, are at our discretion. If you are a consumer, any statutory right of withdrawal you have applies in addition to this.
We may change prices. If a change affects a plan you are on, we will give you at least 30 days' notice by email and it takes effect at your next renewal. Prices include taxes unless stated otherwise.
3. Acceptable Use
You agree not to:
Break the law, infringe anyone's rights, or use the Service to harm anyone.
Attempt to gain unauthorised access to the Service, to other accounts, or to the systems behind them.
Probe, scan, overload or interfere with the Service, or work around rate limits, quotas or plan restrictions to get paid features for free.
Automate, scrape or resell the Service, redistribute its themes, imagery or audio outside the extension, or use them to build a competing product.
Reverse engineer any part of the Service except as the law expressly permits.
Upload malware, or otherwise interfere with other users' devices or accounts.
4. Content: Yours and Ours
To-do items, custom bookmarks, your standing prompt and any similar entries you type into the extension are yours. We claim no ownership of them, and we do not read or use them beyond running the Service for you.
So that we can run the Service, you grant us a licence to store, sync and process the content you enter, solely to operate the Service for you. This ends when you delete the content or your account.
The extension itself, its design, the curated theme catalog, the imagery, audio, our prompts, and the Themefy name and logo belong to us or our licensors (see section 5). These Terms grant you a limited, revocable, non-exclusive licence to use them inside the Service as intended, and nothing more.
Feedback you send us is welcome and we may use it freely, without obligation to you.
5. Third-Party Content in the Extension
Themes, wallpapers and graphics shown in the extension are sourced under licence from providers including Unsplash and Spline, and audio is streamed through Cloudinary. That content stays the property of its creators and licensors.
You may view and use this content inside the extension as intended. You may not download, redistribute, resell or reuse it outside the extension.
Weather and air quality data comes from OpenWeatherMap, based on an approximate location from your IP address; see our Privacy Policy for how that works.
6. Availability, Suspension and Termination
We aim to keep Themefy available, but we do not promise uninterrupted service. We may carry out maintenance, and we may add, change or remove features, including individual themes or catalog categories.
If we discontinue a material part of the Service, we will give reasonable notice and, where you have paid in advance for something you can no longer use, a pro-rata refund.
You can delete your account at any time from settings. That deletes your saved themes, bookmarks, to-dos and profile, so note down anything you want to keep first.
We may suspend or terminate your account if you breach these Terms, if your use puts the Service or other users at risk, or if we are required to by law. Where circumstances allow, we will warn you first and give you a chance to put it right.
Sections that by their nature should survive: our intellectual property, third-party content restrictions, disclaimers, liability and governing law survive termination.
7. Disclaimers, Liability and Indemnity
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and any warranty that the site blocker, timers, weather data or any other feature will be uninterrupted, accurate or error-free.
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, nor for lost profits, revenue, data or business opportunity. Our total liability arising out of or relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars (US$100).
Nothing here excludes liability that cannot lawfully be excluded, and if you are a consumer, your statutory rights are unaffected.
8. Governing Law and General
If you are a consumer, you keep the protection of the mandatory laws of the country you live in. Before starting formal proceedings, please write to support@themefy.top so we can try to resolve things directly.
If a provision is found unenforceable, the rest stays in force.
Our failure to enforce a provision is not a waiver of it.
You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets.
9. Changes to These Terms
We may update these Terms. Any update will be published with a revised "Last updated" date at the top. For material changes we will give at least 30 days' notice by email or in the app, and continuing to use the Service after that means you accept the new Terms. If you do not accept them, please stop using the Service and cancel your plan.
